சமச்சீர்க் கல்வி புத்தகத்தில் இந்தி இந்தியாவின் தேசிய மொழி என்று தவறுதலாக எழுதப்பட்டுள்ளது. இந்தியாவிற்கு என்று ஒரு தேசிய மொழி கிடையாது. இந்தி இந்தியாவின் அலுவல் மொழி (Part XVII, Article 343 of the Constitution of India, Hindi is an official language of India). ஏனென்றால் இந்தியா பல்மொழிப் பேசும் மாநிலங்களின் கூட்டமைப்பு.

சில வட இந்திய ஆதிக்கவாதிகள், இந்தியைத் தேசிய மொழியாக திணிக்க நினைத்தபோது, நம் முன்னோர்கள் அதை முறியடித்தனர். அன்னைமொழியைக் காப்பதற்காக, 65 இளம் மாணவர்கள் துணை இராணுவப் படையின் துப்பாக்கிச் சூட்டை நெஞ்சில் வாங்கி பலியாயினர். 8 பேர் தீக்குளித்து மாண்டனர். ஆனால், தற்போதும் என்ன நடந்து வருகிறது? பின்வாசல் வழியாக ஓசையில்லாமல் இந்தியைத் திணித்து வருகிறார்கள்.

உதாரணத்திற்கு, நடுவண் அரசின்-இளநிலை நுழைவுத் தேர்வு வினாத்தாட்களில் எங்கேப் போனது தமிழ்?, நடுவண் அரசின் பணித்தேர்வு வினத்தாட்களில் எங்கேப் போனது தமிழ்? கல்வியிலும் வேலைவாய்ப்பிலும் சிறுமைப்படுத்தபட்டுக் கிடக்கிறோம். ஒரு ஆய்வு நடத்திப் பாருங்கள்? உண்மை புலப்படும்.

நடுவண் அரசு வங்கிகளின் படிவங்களில் எங்கேப் போனது தமிழ்? தன் தாள்மொழித் தமிழ்ச் சிறப்பாகத் தெரிந்திருந்தும், அந்நிய மொழிகளான, ஆங்கிலம் இந்தியில் அமைந்த வங்கிப் படிவங்களைப் புரிந்து கொள்ள முடியாமல், எத்தனைத் தமிழ் மக்கள் அல்லல் படுகின்றனர். ஐயா, இந்தப் படிவத்தை நிரப்பிக் கொடுங்கள் என்று கையேந்துகிறோம்.

ஏன்! தமிழிலும் அமைக்க மாட்டேன் என்கிறார்கள். அது தான் ஆதிக்கம்.

இதனால் தான், அனைத்து மாநில அலுவல் மொழிகளுக்கும் சம உரிமை கேட்கிறோம். தாய் மொழி என்பது வெறும் ஊடகமில்லை. அம்மொழியைப் பேசும் மனிதர்களின் முன்னேற்றமும் அதில் நிரம்பி உள்ளது. ஒரு மொழிக்கு மட்டும் அவ்வுரிமைக் கிடைக்கும் போது, அதனைச் சார்ந்த மக்கள் அனைவரும் ஏற்றம் பெறுவர். ஏனையர் கடையராவர். அதனால் தான், இந்தியைத் தேசிய மொழி ஆக்க வேண்டாம். அனைத்து மாநில மொழிகளையும் நடுவண் அலுவல் மொழிகள் ஆக்குவோம். என்கிறோம்.

ஏன்? இந்தியைத் தேசிய மொழி ஆக்கக் கூடாது என்கிற விவரங்களைத் தயவுசெய்து பதிவிறக்கம் செய்து படிக்க வேண்டுகிறேன்.
 
இந்திய அரசமைப்புச் சட்டத்திற்கு புறம்பாக, இந்தி மொழியை இந்தியாவின் தேசிய மொழி என்று, சமச்சீர்க்கல்வி புத்தகத்தில் எழுதி வரலாற்றுப் பிழை செய்த முந்தைய அரசு.

இந்தியா பல்மொழி இனங்களின் ஒன்றியமாக இருப்பதால் இந்தியாவிற்கு ஒன்று ஒரு தேசிய மொழி கிடையாது. எனவே தான் இந்தி இந்தியாவின் அலுவல் மொழி (Official Language) ஆக உள்ளது. ஆனால் முந்தைய தி.மு.க. அரசு, 8 ஆம் வகுப்பு மற்றும் 10 ஆம் வகுப்பு சமூக அறிவியல் சமச்சீர்க்கல்வி புத்தகத்தில் இந்திய அரசமைப்புச்சட்டத்தின் பிரிவு 343 ஐத் திருத்தாமலேயே “அலுவல் மொழியான இந்தியை இந்தியாவின் தேசிய மொழி” என்று சட்டவிரோதமாகக் குறிப்பிட்டு தமிழ் மக்களை ஏமாற்றியுள்ளது. இப்புத்தகத்தைப் படிக்கும் அனைத்து தமிழ்க் குழந்தைகளும் இந்தி தேசிய மொழி என்று நம்பும் படியாக சதித்திட்டம் தீட்டி நிறைவேற்றியுள்ளது. இது ஒரு மாபெரும் வரலாற்றுப் பிழை. இந்தித் திணிப்பை எதிர்த்து ஆட்சிக்கு வந்த தி.மு.க. இன்று இந்திக்கு மாயமான் மகுடம் சூட்டி மக்களை ஏமாற்றுவது ஏனோ? முந்தைய ஆட்சியாளர்கள் உடனடியாக தமிழக மக்களிடம் மன்னிப்புக் கேட்க வேண்டும்.

தமிழக அரசு உடனே சமச்சீர்க்கல்வி புத்தகத்தில் அலுவல் மொழி என்று திருத்த வேண்டும். மேலும், பொய்யை எழுதி மெய்யாக்க எண்ணிய ஏ.பி. ஜனார்த்தனம் புத்தகக்குழுவினர் மீது தமிழக அரசு குற்றவியல் வழக்குத் தொடர வேண்டும். இவ் வரலாற்றுப் பிழையால் தமிழ்மொழிக்கும் இந்திய அரசியலிலும் என்னப் பாதிப்புகள் நேரும் என்பதைக் கீழ்வரும் வரிகளில் காண்போம்.

சமச்சீர்க்கல்வி புத்தகத்தில் எழுதப்பட்டப் பகுதி:

சமச்சீர்க்கல்வி சமூக அறிவியல் 8 ஆம் வகுப்பு பாடப்புத்தகத்தில் பக்கம் 164 இல் குடிமையியல் பிரிவில் மொழிகள் என்னும் குறுந்தலைப்பில் “தேவநாகரி வடிவிலான இந்தி எழுத்து இந்தியாவின் தேசிய மொழியாக உள்ளது. ஆங்கிலம் அலுவலக இணைப்பு மொழியாக உள்ளது”. மேலும் பக்கம் 169 இல் “இந்தியாவின் தேசிய மொழி இந்தி ஆகும்” என்று குறிப்பிட்டுள்ளனர்.

இதைத் தயாரித்தவர்களின் விவரங்கள் பின்வருமாறு,

Article 343 – The official language of the Union shall be Hindi in Devanagari script. (பிரிவு 343 – இந்தி இந்தியாவின் அலுவல் மொழி (தேவநாகரி வரி வடிவம்).

சான்று 2

சுரேஷ் கச்சாடியா என்பவர் 2009 இல் இந்தி இந்தியாவின் தேசிய மொழியாக இருப்பதால், இந்தியாவில் விற்பனைக்கு வரும் அனைத்து மருந்துகளின் விவரக்குறிப்புகளையும் இந்தியில் கண்டிப்பாக எழுத நடவண் அரசு நடவடிக்கை எடுக்க வேண்டும் என்று குஜராத் உயர்நீதிமன்றத்தில் பொது நல வழக்கு தொடர்ந்தார். வழக்கை விசாரித்த குஜராத் உயர்நீதிமன்றத் தலைமை நீதிபதி S.J. முகோபாத்யாயா மற்றும் A.S. தாவே ஆகியோரைக் கொண்ட இரு நீதிபதிகள் அமர்வு, “இந்தி இந்தியாவின் அலுவல் மொழி” என்று தான் அரசமைப்புச் சட்டத்தில் குறிப்பிடப்பட்டுள்ளது; தேசிய மொழி என்று எங்குமே இல்லை. எனவே அலுவல் மொழியில் விவரக்குறிப்புகள் வெளியிடத் தேவையில்லை என்று ஜனவரி 2010 இல் தீர்ப்பளித்தது.

சான்று 3

இத்தீர்ப்பைக் கேட்டதும் இந்தியைத் தேசிய மொழியாக எப்படியாவது, பின்வாசல் வழியாகவாவது, கொண்டு வந்தே தீர வேண்டும் என்று நினைக்கும் இந்தியைத் தாய்மொழியாகக் கொண்ட, இந்தி ஆதிக்க நாடாளுமன்ற உறுப்பினர்கள் இதனைப்பற்றி மக்களவையில் வினா நேரத்தின் போது Unstarred வினாக்கள் எழுப்பினர். இதற்கு எழுத்தில் பதிலளித்த உள்துறை அமைச்சகம் கீழ்க்கண்டவாறு கூறியுள்ளது.

கோரக் பிரசாத் ஜெய்ஸ்வால் M.P. (வினா எண்: 6184 / விடையளிக்கப்பட்ட நாள் 04.05.2010) என்பவர், இந்தியை இந்தியாவின் தேசிய மொழி ஆக்குவதற்கு நடுவண் அரசு எடுத்த நடவடிக்கை என்ன என்று கேட்டார்? இதற்குப் பதிலளித்த உள்துறை இணை அமைச்சர் அஜய் மேக்கன், இந்தி இந்தியாவின் அலுவல் மொழி; தேசிய மொழி இல்லை என்று விளக்கம் அளித்துள்ளார்.

இரஞ்சன் பிரசாத் யாதவ் M.P. (வினா எண்: 5068 / விடையளிக்கப்பட்ட நாள் 27.04.2010) என்பவர் குஜராத் உயர்நீதிமன்றம் இந்தி இந்தியாவின் தேசிய மொழி இல்லை. வெறும் அலுவல் மொழி தான் என்று கூறியதற்கு உள்துறை அமைச்சகத்தின் பதில் என்ன என்று கேட்டுள்ளார்? இதற்கு பதிலளித்த உள்துறை அமைச்சகத்தின் அலுவல் மொழித் துறை (Department of Official Language), இந்திய அரசமைப்புச் சட்டத்தில் இந்தி இந்தியாவின் அலுவல் மொழி என்று தான் குறிப்பிடப்பட்டுள்ளது என்று ஒத்துக் கொண்டுள்ளது.

சான்று 4

பா.ம.க. வின் “புதிய அரசியல் புதிய நம்பிக்கை" முன்வரைவு அறிக்கையின் 7 ஆம் பக்கத்தில்

இந்திய நாட்டில் சட்டப்படியான தேசிய மொழி என்று எதுவுமே இல்லை. அரசியல் சட்டத்தின் எட்டாவது அட்டவணையில் குறிப்பிடப்பட்டுள்ள மொழிகள் அனைத்தையும் சமமாகக் கருதி அவற்றை ஆட்சி மொழிகள் ஆக்காமல் இந்தியை மட்டும் அலுவல் மொழி (Official Language) என்று அறிவித்து அதன் வளர்ச்சிக்காக ஆயிரக்கணக்கான கோடி ரூபாயை ஒதுக்கியதோடன்றி இந்தி பேசாத மாநிலங்களில் குறிப்பாகத் தமிழகத்தில் இந்தியைத் திணித்து வருகிறது காங்கிரசுக் கட்சி அரசு. 1965 இல் இந்தியைத் திணித்த போது மக்கள் கிளர்த்தெழுந்து போராடினர். மாணவர்களும் இளைஞர்களுமாக 63 பேரைச் சுட்டுக் கொன்றது காங்கிரசுக் கட்சி அரசு.

இந்திய அரசமைப்புச் சட்டத்தில் தமிழ்மொழியின் நிலைமை:

இந்திய அரசமைப்புச் சட்டத்தின் எட்டாவது அட்டவணையில் தமிழ் உட்பட 22 மொழிகள் அங்கீகரிக்கப்பட்டுள்ளன. ஆனால் அட்டவணையில் இடம் பெற்ற இந்த மொழிகள் வெறும் ‘மொழிகள்’ என்று மட்டுமே குறிப்பிடப்பட்டுள்ளன. அவைகள் தேசிய மொழிகள் என்றோ ஆட்சி மொழிகள் என்றோ அலுவல் மொழிகள் என்றோ குறிப்பிடப்படவில்லை. ஏன் இந்திய மொழிகள் என்று கூட குறிப்பிடப்படவில்லை.

இந்தி தேசிய மொழி ஆகாமல் இருப்பதன் காரணம்:

தமிழ்நாட்டு மாணவர்கள் 1937 மற்றும் 1965 இல் சிந்திய உதிரங்களின் தாக்கமும் மாநிலக் கட்சிகளின் வளர்ச்சியும் தான் இதற்குக் காரணம். இந்தியை தேசிய மொழி ஆக்க வேண்டுமென்றால் அரசமைப்புச் சட்டத்தை திருத்தம் செய்ய வேண்டும். அதற்கு அனைத்து மாநில மக்களின் சம்மதமும் வேண்டும். Official language is to be approved by law to become the National language.

இந்தி தேசிய மொழியானால் என்ன நடக்கும்?

தேசியக்கொடி, தேசிய கீதம், ....போன்ற தேசியச் சின்னங்களுக்கு கொடுக்கப்படும் புனிதத்தன்மை, அரசமைப்பு அங்கீகாரம், கட்டாயம் மற்றும் சட்டப்பாதுகாப்பு போன்றவை கிடைக்கும். தேசியக்கொடியை அவமதித்தால் என்ன நிகழுமோ அதைப்போல் இந்தித் திணிப்பை அவமதித்தாலும் சிறைக்குச் செல்ல வேண்டி வரும்.

இந்தி கண்டிப்பாக படிக்க வேண்டும். படிக்காதவர்கள் தேச விரோதிகள் என்று முத்திரைக் குத்தப்படுவார்கள்.

உச்சநீதிமன்றத்தில் இந்தி வழக்காடு மொழி ஆகும்.

நுழைவுத்தேர்வு, பணித்தேர்வு, வங்கி, பயிற்று மொழி, அஞ்சலகம், குடியரசுத் தலைவர் உரை, பிரதமர் உரை,......போன்ற அனைத்தும் இந்தியில் மட்டுமே இருக்கும்.

இந்திக்கு கொடுத்தது போல் தமிழுக்கும் கொடு எனறு நாம் கேட்கக் கூட முடியாமல் போகும்.

இந்தியா என்றாலே இந்தி மொழி பேசுபவர் வாழும் நாடு என்னும் நிலைமை ஏற்படும்.

தமிழ் உட்பட இதர மொழிகள் அங்காடி மொழியாகும்.

தமிழகத்தின் unique இருமொழிக்கொள்கைக்கு பாதிப்பு ஏற்படும்.

கோரிக்கை:

1.இந்திய அரசமைப்புச்சட்டத்தின் பிரிவு 343 ஐ திருத்தாமலேயே, சட்ட விரோதமாக இந்தியை தேசிய மொழியாக சமச்சீர்க்கல்வி புத்தகத்தில் எழுதியவர்களை மக்கள் வன்மையாகக் கண்டிக்க வேண்டும். இதனைப் பாடக்குறிப்பிலிருந்து அலுவல் மொழி என்று திருத்த வேண்டும்.

2.14 வயதிலேயே இந்தியை எதிர்த்தேன் என்றும் தமிழை மத்தியில் அலுவல் மொழி ஆக்கப் போராடி வருகிறேன் என்று பிதற்றிக் கொள்ளும் தி.மு.க. சட்ட விரோதமாக இந்தியைத் தேசிய மொழி என்று அறிவித்ததற்கு தமிழக மக்களிடம் என்ன பதில் கூறப் போகிறது.

3.ஆண்டு தோறும் இந்தி எதிர்ப்பு நாள், சிலை நிறுவல் என்று இந்தி ஆதிக்க எதிர்ப்புப் போராட்டத்தை பெருமைப்படுத்தும், தமிழக அரசு இப்பாடக்குறிப்பை உடனடியாக அலுவல் மொழி என்று திருத்த வேண்டும்.

4.தமிழக அரசு இதனை எழுதிய ஏ.பி.ஜனார்த்தனம் பாடக்குழுவினர் மீது குற்றவியல் வழக்குத் தொடர வேண்டும்.

முடிவுரை:

எனவே இந்திய அரசமைப்புச் சட்டத்திற்கு எதிராகவும், குஜராத் உயர்நீதிமன்றத் தீர்ப்புக்கு எதிராகவும், நாடாளுமன்ற மாண்புகளுக்கு எதிராகவும், இந்தியை எதிர்த்து மாண்ட தியாகச் செம்மல்களின் ஈகத்தை இழிவுபடுத்தியும், தமிழக மக்களின் உணர்வுகளைப் புண்படுத்தியும், நடுவண் அரசு கூட நடைமுறைப்படுத்த இயலாத ஒரு செயலை சட்டவிரோதமாக தேசிய மொழி என்று அறிவித்த முந்தைய ஆட்சியாளர்களை வன்மையாகக் கண்டிக்கிறோம்.

உடனடியாக அரசமைப்புச் சட்டத்தில் உள்ளதைப்போல் அலுவல் மொழி என்று திருத்த வேண்டும்.

(b) if so, the details thereof and the reaction of the Government thereto; and

(c) the details of the steps taken by the Government to accord Hindi its rightful status as provided in the Indian Constitution?

ANSWER

(a): Yes, Madam.

(b): The Gujarat High Court has made an observation in public interest litigation that there has neither been made any provision nor has any order been issued in order to declare Hindi as a National Language of the Country. The Department of Official Language agrees with the observation of the Gujarat High Court.

(c): Hindi is the official language of the Union under Article 343 of the Constitution of India. According to the provisions made under Article 344(4) of the constitution, President`s orders were issued on various points relating to development and propagating the Official Language Hindi on 27-04-1960 after the inspections carried out by the 30 member committee of Parliament on Official Language constituted to consider the recommendations of the Official Language Commission. Official Languages Act, 1963 was framed for the official purposes of the Union, for transaction of business in Parliament, for Central and State Acts and for certain purposes in High Courts. To speed up the expansion and development of Hindi, Official Language Resolution, 1968 was passed by the both Houses of the Parliament. For the smooth implementation of the provisions made in the Official Language Act, 1963, Official Language Rules were framed in 1976. After declaring Hindi as the Official Language of the Union, following Committees have been constituted to increase the use of Hindi extensively in the official work of the Government:

1. The Committee of Parliament on Official Language.

2. Kendriya Hindi Samiti under the Chairmanship of the Prime Minister.

3. Hindi Salahakar Samiti in every Ministry/Department under the Chairmanship of respective Minister.

4. Central Official Language Implementation Committee under the Chairmanship of Secretary, Department of Official Language.

5. Departmental Official Language Implementation Committee in every Ministry/ Department under the Chairmanship of the Joint Secretary concerned.

6. Town Official Language Implementation Committees in various major towns of the country.

Besides this, administrative orders are issued from time to time by the Department of Official Language for the implementation of the Official Language policy. The Department of Official Language monitors the implementation of the Official Language policy on the basis of the Quarterly Progress Reports received from all the Ministries/Departments and for this purpose an Annual Programme and Annual Assessment Report is prepared every year.

Gujarat High Court has observed that though majority of people in India have accepted Hindi as a national language, there was nothing on record to suggest that any provision has been made or order issued declaring Hindi as a national language of the country.

The observation was made by division bench of Chief Justice S.J. Mukhopadhaya and justice A.S. Dave recently while rejecting a Public Interest Litigation (PIL) by one Suresh Kachhadia.

Mr. Kachhadia had filed the PIL last year seeking direction to Central and State government to make it mandatory for manufacturers to print details of goods like price, ingredients and date of manufacture in Hindi.

The court observed, “Normally, in India, majority of the people have accepted Hindi as a national language and many people speak Hindi and write in Devanagari script but there is nothing on record to suggest that any provision has been made or order issued declaring Hindi as a national language of the country.”

“No mandamus can be issued on any manufacturer or others for giving details or particulars of package in Hindi in Devanagari script,” it further said.

It was contended by Mr. Kachhadia’s lawyer that Hindi was the national language and was understood by a large number of persons in the country.

The Counsel representing central government submitted that specific provision has been made under the Standard of Weight and Measures (Packaged Commodities) Rules of 1977 that particulars of declaration should be in Hindi in Devanagari script or in English.

The court said that the Constituent Assembly while discussing the Language Formula noticed the recommendation of the Sub-Committee on Fundamental Rights, which recommended the formula as per which, “Hindustani, written either in Devanagari or the Persian script at the option of the citizen, shall, as the national language, be the first official language of the Union. English shall be the second official language for such period as the Union may, by law, determine.”

However, in the constitution, Hindi was declared as an official language and not a national language.

The court in its order said Part XVII of the Constitution deals with Official Language. Under Article 343, official language of the Union has been prescribed, which includes Hindi in Devanagari script and English.

THERE’S NO NATIONAL LANGAUGE IN INDIA: GUJARAT HIGH COURT

AHMEDABAD: Does India have a national language? No, says the Gujarat High Court. The court also observed that in India, a majority of people have accepted Hindi as a national language and many speak Hindi and write in Devanagari script, but it's not officially the national language.

With this observation, a bench headed by Chief Justice S J Mukhopadhaya refused to issue directions that packaged commodities must contain details about goods in Hindi.

Petitioner Suresh Kachhadia had, in 2009, filed a public interest litigation (PIL) in the Gujarat HC seeking mandamus to the Centre as well as the state government to make it mandatory for manufacturers of goods to print in Hindi, all details of goods like price, ingredients and the date of manufacture. His contention was that the consumers are entitled to know what they are consuming.

It was argued that because Hindi is the national language and is understood by a large number of people in the country, directions should be given to publish all such details in Hindi. His counsel placed reliance on the deliberations in the Constituent Assembly in his arguments. Even the Centre's counsel referred to the Standard of Weights and Measures (Packaged Commodities) Rules and told the court that such declaration on packets should be either in English or in Hindi in Devanagari script.

But the court asked whether there was any notification saying Hindi is India's national language, for it's an ``official language'' of this country. No notification ever issued by the government could be produced before the court in this regard. This is because the Constitution has given Hindi the status of the official language and not the national language.

The court concluded that the rules have specific provisions for manufacturers that particulars of declaration should be in Hindi in Devanagari script or in English, and it's their prerogative to use English. Therefore, no mandamus can be issued on manufacturers or governments for giving details or particulars of package in Hindi.
